Teachers sidestep new IR laws

Tasmania's public school teachers have become the first in Australia to
sidestep the Federal Government's industrial relations (IR) changes.

The Industrial Relations Commission (IRC) today deregistered the teacher's
federal award and two other workplace agreements.

The Tasmanian Industrial Commission has now formally registered the teachers
under a state award, which contains identical conditions to the one they
have left.

AEU Tasmanian president Jean Walker says the move will benefit more than
5,500 public sector teachers.

"I think that the worst of the proposed IR legislation proposals we'll be
protected from," she said.

"Those sorts of unfair dismissal and Australian Workplace Agreements.

"The sort of stripping away of rights and conditions - we'll be protected
from those under the state commision

I wonder if that would work. Under law, a federal law has precedence
over a state.

Not if it's constitutionally against a States right. That would require a
referrendum.

The way it is now is that a federal law overwrites a state law in
industrial relations, to change this, might need a referrendum.
